Flavored disposable vape bans are now in effect in roughly a dozen U.S. states, with several more enforcing strict registry-only rules that effectively eliminate most popular brands. States with full flavored disposable vape bans (2026)

These states ban the sale of flavored disposable vapes (and in most cases, all flavored vape products beyond tobacco):

  • California — SB 793 prohibits flavored tobacco products, including most flavored disposables.
  • Massachusetts — Flavored vape sales restricted to licensed smoking bars only (effectively a retail ban).
  • New Jersey — Flavored vape sales banned at retail since April 2020.
  • New York — Statewide ban on flavored vape products excluding tobacco.
  • Rhode Island — Flavored e-cigarette ban in effect.
  • Utah — Restricts flavored vapes to licensed specialty tobacco retailers; most disposables effectively unavailable.

States with strict registry / PMTA-only enforcement

These states allow flavored vapes only if the specific product has FDA marketing authorization or appears on a state registry. In practice this excludes nearly all popular disposable vape brands:
