States Where Flavored Disposable Vapes Are Banned (2026 Map)
Flavored disposable vape bans are now in effect in roughly a dozen U.S. states, with several more enforcing strict registry-only rules that effectively eliminate most popular brands. If you're trying to figure out whether you can legally buy flavored disposables where you live — or whether an online retailer can ship them to you — this 2026 guide lays out the current state-by-state status.
Important: This is informational only, not legal advice. Vape laws change quickly and enforcement varies. Always check your state's department of health or attorney general site for the latest. We update this article quarterly.
States with full flavored disposable vape bans (2026)
These states ban the sale of flavored disposable vapes (and in most cases, all flavored vape products beyond tobacco):
- California — SB 793 prohibits flavored tobacco products, including most flavored disposables.
- Massachusetts — Flavored vape sales restricted to licensed smoking bars only (effectively a retail ban).
- New Jersey — Flavored vape sales banned at retail since April 2020.
- New York — Statewide ban on flavored vape products excluding tobacco.
- Rhode Island — Flavored e-cigarette ban in effect.
- Utah — Restricts flavored vapes to licensed specialty tobacco retailers; most disposables effectively unavailable.
States with strict registry / PMTA-only enforcement
These states allow flavored vapes only if the specific product has FDA marketing authorization or appears on a state registry. In practice this excludes nearly all popular disposable vape brands:
- Louisiana — Vape directory law restricts sales to FDA-authorized products.
- Oklahoma — Registry law in effect, most disposables blocked.
- Alabama — Restrictive registry rules.
- Wisconsin — Effective restrictions on most disposable brands.
- Vermont — Online sales of vape products to consumers heavily restricted.
- Maine — Online sales restrictions on vape products.
- Washington (state) — Strong restrictions; some flavored disposables blocked.
States with local-level bans or partial restrictions
Some states allow flavored disposables statewide but have city or county-level bans. These include parts of Illinois (Chicago), Minnesota (some cities), Colorado (Boulder, Denver), and Oregon (some counties). Check local ordinances before purchasing.
What is generally still allowed nationwide?
- Tobacco-flavored vape products (these are exempt from most flavor bans)
- FDA-authorized products (a very limited list)
- Adult use age 21+ in all states
- Online purchases from retailers compliant with the PACT Act (adult signature required on delivery)

Why the 38-state coverage is still better than competitors
Vapekage's 38-state ship-to list is one of the broadest among compliant online vape retailers. Many shops cap at 30-32 states. Read our breakdown: Online Vape Stores That Ship to All States (2026).
Why responsible compliance matters
Some online vape shops technically ship to banned states. They're either operating illegally, shipping discreetly without proper labeling, or relying on the buyer to assume the legal risk. Vapekage chooses compliance — every shipment leaves with PACT Act labeling, adult signature required (21+), and proper state-by-state filtering at checkout. It's why we can stay in business serving the 38 states where we operate legally.
Frequently asked questions
Are all disposable vapes banned in California? Flavored disposables, yes (SB 793). Tobacco-flavored disposables are still legally available. Vapekage does not ship to California.
Can I buy flavored disposables online if I live in a banned state? Compliant retailers won't ship to you. Some non-compliant shops will, but you're taking on legal and quality risk — counterfeits are common in grey-market shipments.
Will more states ban flavored disposables in 2026-2027? Likely yes. Several states have legislation pending. Watch Illinois, Connecticut, Hawaii, and Washington D.C. for potential expansion.
Why doesn't Vapekage ship to Wisconsin? Wisconsin's vape directory law makes most popular disposable brands legally unsellable to consumers in the state. Rather than ship products that may be seized or violate state law, we exclude WI from our ship-to list.
What states does Vapekage ship to? 38 states across most of the South, Midwest, Mountain West, and Southeast. Texas is our home state and our fastest-shipping zone. Check checkout for live state availability.
