What Is the PACT Act?

The Prevent All Cigarette Trafficking Act (PACT Act) is a federal law originally enacted in 2009 and significantly amended in 2020 to include electronic nicotine delivery systems (ENDS) — such as e-cigarettes, vape devices, e-liquids, and related components.

The PACT Act establishes strict requirements for any person or business engaged in the online sale and interstate shipment of cigarettes, smokeless tobacco, and ENDS products. Its primary goals are to:

- Prevent the sale of tobacco and nicotine products to minors
- Ensure proper collection and remittance of all applicable taxes
- Require age verification at purchase and adult signature at delivery
- Prohibit the use of private-carrier compliant courier for shipping tobacco and ENDS products
- Mandate registration and reporting to federal, state, and tribal authorities

FEDERAL LAW: The PACT Act applies to all online retailers of vape and nicotine products in the United States. Vapekage is fully registered and compliant with all PACT Act requirements. Non-compliance carries severe federal penalties including fines and imprisonment.

Our Compliance Overview

Vapekage takes PACT Act compliance seriously. As a licensed online retailer operating from Texas, USA, we have implemented comprehensive policies and procedures to meet or exceed every requirement of the PACT Act and its 2020 amendments.

Our compliance program covers the following core areas:

- Age verification at the point of sale and point of delivery
- Shipping restrictions using only approved private carriers
- Tax collection and remittance for all applicable jurisdictions
- Registration and reporting with federal and state authorities
- Recordkeeping of all transactions involving ENDS products
- Labeling and packaging requirements for all shipments

Age Verification Requirements

The PACT Act requires that all online sellers of ENDS products verify the age of the purchaser before the first delivery to that customer using a commercially available database or aggregate of databases. Vapekage exceeds this requirement by verifying age on every order.

At checkout: Our secure third-party verification system cross-references your name, date of birth, and address against public records databases to confirm you are at least 21 years old. If automatic verification fails, manual ID upload is required.

At delivery: Every shipment requires an adult signature from a person aged 21+ with a valid government-issued photo ID. The carrier is required to verify the recipient's identity and age before releasing the package.

Orders that cannot be age-verified are cancelled and refunded. No exceptions are made to this policy.

Shipping Requirements

The 2020 amendments to the PACT Act prohibit the United States Postal Service (private-carrier compliant courier) from accepting or delivering packages containing ENDS products, cigarettes, or smokeless tobacco. This ban took effect on October 21, 2021.

Vapekage ships all orders exclusively through approved private carriers that have implemented PACT Act-compliant delivery procedures, including adult signature collection and ID verification at the door.

Additional shipping requirements we follow:

- All packages are clearly labeled as containing tobacco/nicotine products as required by law
- All packages bear the required warning: "CIGARETTES/NICOTINE/ENDS — ADULT SIGNATURE REQUIRED — CONTAINS TOBACCO PRODUCTS"
- Packages are shipped only to physical street addresses (no P.O. Boxes, APO/FPO/DPO)
- We do not ship to states or jurisdictions that prohibit online sales of ENDS products
- We do not ship internationally

private-carrier compliant courier PROHIBITION: It is illegal to ship vape and nicotine products via PACT Act-compliant private carrier. All Vapekage orders are shipped exclusively through approved private carriers with adult signature and ID verification at delivery.

Tax Collection & Remittance

The PACT Act requires online sellers of ENDS products to collect and remit all applicable federal, state, local, and tribal taxes — including excise taxes, sales taxes, and any other taxes that would apply to an in-person sale of the same product in the buyer's state.

Vapekage complies fully with all tax obligations:

- All applicable taxes are calculated and displayed at checkout before you complete your purchase
- Tax rates are determined by your shipping address and the specific products in your order
- Collected taxes are remitted directly to the appropriate federal, state, and local tax authorities
- We maintain detailed records of all tax collections as required by law

Vapekage does not profit from tax collection. All taxes collected are passed through to the relevant government authorities.

Registration & Reporting

The PACT Act requires all online sellers of ENDS products to register and file reports with multiple government entities. Vapekage maintains all required registrations and filings:

Federal registration: Vapekage is registered with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) as required by the PACT Act for all delivery sellers of ENDS products.

State reporting: We file required reports with the tobacco tax administrators of every state into which we ship products. These reports include the names and addresses of recipients, the quantities and types of products shipped, and the amount of taxes collected.

Monthly reporting: We submit monthly reports to applicable state authorities detailing all shipments made into their jurisdiction during the preceding month, as required by law.

All registration and reporting records are maintained for the periods required by federal and state law.

Recordkeeping Obligations

The PACT Act imposes detailed recordkeeping requirements on online sellers of ENDS products. Vapekage maintains complete records of:

- Every sale and shipment of ENDS products, including customer information, products sold, quantities, and prices
- All age verification results (both successful and failed)
- All tax calculations, collections, and remittances
- All carrier tracking information and delivery confirmations with adult signatures
- All registrations, reports, and correspondence with federal and state authorities

These records are maintained securely for the minimum retention periods required by law (typically 4-5 years depending on jurisdiction) and are available for inspection by authorized federal and state officials upon request.

Packaging & Labeling Requirements

All shipments from Vapekage comply with PACT Act packaging and labeling requirements:

- Every package is clearly and conspicuously labeled on the outside to indicate it contains tobacco/nicotine/ENDS products
- Packages include the required adult signature delivery notice
- Return address clearly identifies Vapekage as the sender
- No misleading or deceptive labels that could obscure the nature of the contents
- Packages comply with all carrier-specific labeling requirements for ENDS shipments

These labeling requirements ensure that carriers properly handle ENDS shipments and enforce the adult signature requirement at delivery.

State Restrictions

In addition to federal PACT Act requirements, individual states may impose their own restrictions or outright bans on the online sale and delivery of ENDS products. Vapekage monitors state-level regulations and does not ship to any state or jurisdiction where online delivery of ENDS products is prohibited by law.

If you place an order with a shipping address in a restricted jurisdiction, your order will be cancelled and fully refunded. We will notify you via email with an explanation.

Penalties for Non-Compliance

The PACT Act carries serious penalties for non-compliance. While this section is provided for informational purposes, it underscores the gravity with which Vapekage treats its compliance obligations:

Criminal penalties: Violations of the PACT Act can result in federal criminal prosecution, with penalties of up to 3 years imprisonment for general violations and up to 5 years for trafficking offenses.

Civil penalties: Civil fines of up to $5,000 per violation may be imposed, with each day of a continuing violation constituting a separate offense.

Forfeiture: Products shipped in violation of the PACT Act are subject to seizure and forfeiture by federal authorities.

How This Affects Your Order

As a Vapekage customer, PACT Act compliance means the following for your experience:

At checkout: You will be asked to provide your date of birth and personal information for age verification. This is a legal requirement, not optional.

At delivery: Someone aged 21+ must be home to sign for your package with a valid photo ID. Packages cannot be left at the door or released without a signature.

Shipping speed: We use private carriers only (not private-carrier compliant courier), which may affect available shipping options and delivery times for certain areas.

Taxes: All applicable taxes are collected at checkout. Prices displayed on product pages may not include taxes — the final amount including taxes is shown before you confirm your order.

Restricted areas: We cannot ship to certain states or address types. If this affects your order, you will be notified and refunded.
