Texas Sales Tax Policy

Vapekage is based in Texas and collects all applicable sales and excise taxes as required by federal, state, and local law. Here's everything you need to know about taxes on your order.

Overview

Vapekage operates from Texas, USA and is required by law to collect and remit applicable taxes on all orders. This includes state and local sales taxes as well as excise taxes on nicotine and tobacco products where applicable.

All taxes are calculated automatically at checkout based on your shipping address and the products in your cart. The total tax amount is displayed before you confirm your order so there are no surprises. Vapekage does not profit from tax collection — every dollar collected is remitted to the appropriate government authority.

Texas State Sales Tax

The state of Texas imposes a 6.25% state sales tax on most retail purchases, including vape devices, e-liquids, accessories, and related products. This is the base rate applied to all taxable goods sold in Texas.

In addition to the state rate, local jurisdictions (cities, counties, transit authorities, and special purpose districts) may impose additional local sales taxes of up to 2%, bringing the maximum combined sales tax rate to 8.25% in some areas.

For orders shipped within Texas, sales tax is calculated based on the combined state + local rate for your specific shipping address. For orders shipped to other states, the applicable tax rate for that state and locality is applied instead.

NOTE: Tax rates vary by location. The exact rate applied to your order depends on your shipping address and is calculated automatically at checkout. The maximum combined rate in Texas is 8.25% (6.25% state + up to 2% local).

Nicotine & Tobacco Excise Taxes

In addition to standard sales tax, many states impose excise taxes specifically on nicotine and tobacco products. These excise taxes are separate from and in addition to regular sales tax.

Excise tax structures vary significantly by state and may be calculated as:

- A percentage of the wholesale or retail price (ad valorem tax)
- A flat rate per unit (e.g., per milliliter of e-liquid, per cartridge, per device)
- A combination of both methods

As of the date of this policy, Texas does not impose a state-level excise tax specifically on vapor products. However, this may change as state legislatures continue to address vape product taxation. Vapekage monitors all legislative changes and will update our tax collection accordingly.

For orders shipped to other states, we collect all applicable state and local excise taxes on nicotine products as required by the PACT Act and state law.

Multi-State Tax Collection

Because Vapekage ships to customers across the United States, we are required to collect taxes in multiple states under economic nexus laws and PACT Act requirements.

Economic nexus: Following the 2018 Supreme Court ruling in South Dakota v. Wayfair, states may require out-of-state online retailers to collect and remit sales tax if the retailer exceeds certain sales thresholds in that state — even without a physical presence there.

PACT Act obligations: The PACT Act independently requires online sellers of nicotine products to collect and remit all applicable state, local, and tribal taxes that would apply to an in-person sale in the buyer's jurisdiction.

Vapekage complies with both sets of requirements. The tax rate applied to your order is determined by your shipping address and reflects all applicable state and local taxes for that jurisdiction.

How Taxes Are Calculated

Tax calculation at checkout follows this process:

1. Product classification: Each item in your cart is classified for tax purposes (device, e-liquid, accessory, etc.) as different product types may be taxed at different rates in certain jurisdictions.

2. Destination determination: Your shipping address is used to identify the applicable state, county, city, and any special taxing districts.

3. Rate lookup: The correct combined tax rate for your specific location and product types is retrieved from our tax calculation system, which is updated regularly to reflect current rates.

4. Tax applied: The calculated tax is applied to your order subtotal and displayed as a separate line item at checkout before you confirm your purchase.

Shipping charges may or may not be subject to sales tax depending on state law. In Texas, shipping charges that are part of a taxable sale are generally subject to sales tax.

Tax-Exempt Purchases

Vapekage does not currently offer tax-exempt purchasing for individual consumers. All applicable taxes are collected on every order as required by law.

If you are a registered reseller with a valid state resale certificate or tax-exempt organization with proper documentation, please contact us before placing your order. We may be able to accommodate tax-exempt sales for qualifying businesses with proper documentation on file.

Tax-exempt status must be verified and approved before an order is placed. We cannot retroactively remove taxes from completed orders.

Taxes on Refunds & Returns

When a refund is issued for a returned product, the applicable sales tax collected on that item is also refunded. You will receive a refund of both the product price and the tax that was charged on it.

For partial refunds (e.g., one item from a multi-item order), only the tax attributable to the refunded item is returned. The tax on the remaining items in the order is unaffected.

Refunded tax amounts are reflected in your refund confirmation email and will appear on your payment statement along with the product refund.

Receipts & Tax Documentation

Every order confirmation email from Vapekage includes a detailed receipt showing:

- Product subtotal
- Itemized tax amounts (sales tax, excise tax where applicable)
- Shipping charges
- Total amount charged

You can also access order receipts at any time by logging into your account on vapekage.com. If you need a duplicate receipt, a formal tax invoice, or documentation for tax filing purposes, please contact our support team and we will provide it promptly.

Changes to Tax Rates

Tax rates are subject to change as federal, state, and local governments adjust their tax policies. Vapekage updates our tax calculation system regularly to reflect current rates and new legislation.

We cannot guarantee that the tax rate on a future order will be the same as a previous order, even if the products and shipping address are identical. Tax rates are always applied based on the rates in effect at the time of purchase.

If a significant tax change affects our customers (such as a new state excise tax on vape products), we will make reasonable efforts to communicate the change through our website and email communications.
