There's no single hidden tax — it's a stack of three things: state sales tax, federal PACT Act adult-signature fee, and shipping. This guide breaks down exactly what each one is, what it costs, and why Texas is actually one of the cheaper states to buy vapes in.

1. Texas state sales tax (6.25%)

Texas charges a flat 6.25% state sales tax on disposable vapes. Same rate as any other taxable retail good. This is collected by the retailer at checkout and remitted to the Texas Comptroller monthly.

2. Local sales tax (0% to 2%)

Texas cities, counties, and special purpose districts can add up to 2.0% in local sales tax on top of the state's 6.25%. Most Texas major metros are at the maximum 2.0% local rate, putting their combined sales tax at 8.25%.

What Texas does NOT charge (and why this matters)

  • No state vape excise tax: Texas does not impose a separate excise (per-unit or per-mL) tax on disposable vapes. Many states do, including California, Connecticut, DC, Maine, Massachusetts, New Jersey, New York, Pennsylvania, Washington, and others. In some of those states, excise taxes add 60-80% on top of the device price.
  • No state-level vape-specific sales tax surcharge: Disposables are taxed at the standard 6.25% rate, not a higher "sin tax" rate.

The pattern: states with vape excise taxes typically stack 30-90% additional cost on top of sticker price. Texas keeps it at standard sales tax — the buyer pays roughly 8% above sticker, not 50-90%.

Why we charge tax (we have to)

Vapekage holds a Texas Comptroller sales tax permit. We're required by Texas state law to collect and remit sales tax on every Texas-shipped order. We're also required by PACT Act to file monthly transaction reports with the Texas Comptroller — meaning Texas knows about every transaction we process, and we cannot skip the tax collection step.

Out-of-state vape retailers selling to Texas addresses are also required to collect Texas sales tax under Wayfair (the 2018 Supreme Court decision that obligates out-of-state sellers to collect destination-state sales tax).
