Age Verification Policy

Vapekage is fully committed to ensuring that vape and nicotine products are sold only to adults of legal purchasing age. We maintain a strict 21+ age requirement in compliance with all applicable federal, state, and local laws.

We have implemented a multi-layered age verification system that checks every customer's age before purchase and again at the point of delivery. No exceptions are made to this policy under any circumstances.

Our age verification practices comply with the following laws and regulations:

Federal PACT Act (Prevent All Cigarette Trafficking Act): Requires online retailers of nicotine products to verify the age of all purchasers using a commercially available database, and to require an adult signature (21+) with ID verification at the point of delivery.

Federal Tobacco 21 Law: Raised the minimum age for sale of all tobacco and nicotine products from 18 to 21 nationwide, effective December 2019.

State Laws: Many states have additional age verification requirements for online sales of vape and nicotine products. Vapekage complies with all state-specific regulations applicable to the customer's shipping address.

FDA Regulations: The Food and Drug Administration regulates the manufacture, distribution, and marketing of tobacco products, including requirements around youth access prevention.

When you first visit vapekage.com, you will be presented with an age verification gate that requires you to confirm you are 21 years of age or older before accessing the site.

This initial gate is a first line of defense. It does not replace the more rigorous identity-based verification that occurs during the checkout process. Falsely representing your age to access the site is a violation of our Terms of Service and may be a violation of applicable law.

During the checkout process, every customer must pass an automated age verification check before their order can be processed. This verification uses the following information:

- Full legal name
- Date of birth
- Residential address
- Last four digits of Social Security Number (in some cases)

This information is cross-referenced against public records databases maintained by our third-party age verification partner. The process is instant in most cases and does not require uploading any documents.

If automatic verification cannot confirm your age, you will be prompted to complete manual verification by uploading a clear photo of a valid government-issued ID (driver's license, state ID card, passport, or military ID).

If our automated system cannot verify your age, you may be asked to provide a government-issued photo ID. Accepted forms of identification include:

- U.S. driver's license
- U.S. state-issued identification card
- U.S. passport or passport card
- U.S. military identification card

Your ID must be valid (not expired) and clearly show your full name, date of birth, and photo. Uploaded IDs are reviewed by our verification team, typically within 24 hours.

All uploaded identification documents are handled securely, encrypted in transit and at rest, and are used solely for age verification purposes. We do not store copies of your ID longer than necessary to complete the verification process. See our Privacy Policy for details on data handling.

In compliance with the PACT Act, every delivery of vape or nicotine products requires an adult signature from a person aged 21 or older at the delivery address.

At the time of delivery, the carrier will:

- Request a valid government-issued photo ID from the recipient
- Verify that the recipient is at least 21 years old
- Collect an adult signature confirming receipt

Packages cannot be left at the door, in a mailbox, or with a minor. If no eligible adult is available to sign, the carrier will leave a delivery notice and attempt redelivery the next business day, or hold the package at a nearby facility for pickup.

This requirement cannot be waived for any reason, including customer request, delivery instructions, or building management authorization.

If we are unable to verify your age through either the automated system or manual ID review, the following will occur:

Order not yet placed: You will be unable to complete checkout until age verification is successful.

Order already placed: Your order will be placed on hold pending successful verification. If verification fails within 48 hours, the order will be automatically cancelled and a full refund will be issued to your original payment method.

Repeat failures: Accounts with multiple failed verification attempts may be flagged for review or permanently restricted from purchasing.

We understand that occasional verification issues can occur due to name changes, recent moves, or database discrepancies. If you believe your verification failed in error, please contact us and we will work with you to resolve it.

Vapekage partners with industry-leading, COPPA-compliant age verification providers to ensure accurate and secure verification. Our verification partners:

- Use encrypted, secure connections for all data transmission
- Access only publicly available and commercially licensed databases
- Do not sell, share, or use your personal information for marketing
- Comply with all applicable privacy laws including CCPA and state-level regulations
- Are regularly audited for accuracy and security compliance

Your personal information submitted for verification is processed in real time and is not stored by the verification provider beyond what is necessary to complete and document the verification.

We take the privacy and security of your personal information seriously. All data collected during the age verification process is:

- Encrypted in transit (TLS/SSL) and at rest (AES-256)
- Used exclusively for age verification and legal compliance
- Never sold to third parties or used for marketing purposes
- Retained only as long as required by law or for legitimate business purposes
- Accessible only to authorized personnel on a need-to-know basis

Vapekage takes the following additional measures to prevent underage access to our products:

- Age gate on site entry requiring 21+ confirmation
- Automated age verification at checkout using public records
- Manual ID verification as a fallback when automated checks are inconclusive
- Adult signature with ID check required at every delivery
- Marketing restrictions: We do not market to anyone under 21, and we do not use advertising channels, influencers, or imagery that target minors
- Account monitoring: Accounts suspected of being used by minors or on behalf of minors are investigated and may be permanently banned

- Order cancellation without refund

- Civil or criminal liability under applicable federal and state statutes

Vapekage cooperates fully with law enforcement agencies investigating underage purchases of tobacco and nicotine products.
