Texas Vape Laws 2026 — Complete Guide for Buyers
Texas is one of the more vape-friendly states in the U.S. — but "friendly" doesn't mean "no rules." If you buy disposable vapes online and live in Texas, there are five regulatory layers stacked on top of you: federal age law (T21), federal shipping law (PACT Act), Texas Health & Safety Code, Texas tax code, and local city/county ordinances. This guide explains all five in plain English so you know exactly what's legal, what's required at checkout, and what to expect when your order arrives.

The 5 layers of Texas vape law
1. Federal Tobacco 21 (T21)
Since December 2019, the federal minimum age to purchase nicotine products in the U.S. — including disposable vapes — is 21. This applies in Texas regardless of state law. Every legitimate online vape retailer must verify age 21+ before completing a transaction. 2. PACT Act (federal shipping law)
The Prevent All Cigarette Trafficking Act, expanded in 2021 to cover vape products, sets the rules for online vape sales:
- Age verification at point-of-sale (21+)
- Adult signature required at delivery (no leaving on the porch)
- Retailer must register with ATF and report monthly sales to state tax authorities
- USPS, UPS, and FedEx all restrict vape shipping under PACT — most legitimate retailers use USPS Priority with adult signature

3. Texas Health & Safety Code (state law)
Texas codifies the federal 21+ minimum age and adds a few state-specific rules:
- Sales to minors carry criminal penalties for the retailer (Class C misdemeanor minimum)
- Public-place use restrictions — most Texas cities ban vaping where smoking is banned (restaurants, bars, public buildings, schools, hospitals)
- Vaping is banned within 1,000 feet of schools (state preemption)
- Texas registered vape retailers must hold a permit from the Texas Comptroller
4. Texas tax code
Texas charges 6.25% state sales tax on disposable vapes. Local jurisdictions can add up to 2.0% more, putting most Texas markets at 7.25–8.25% combined sales tax. Texas does NOT currently charge a separate excise tax on vape products (unlike California, Connecticut, or DC). 5. Local city/county ordinances
Several Texas cities have passed local vape ordinances stricter than state law:
- Austin: Vaping banned in city parks, on public transit, in city-operated buildings
- Dallas: Vaping banned in restaurants, bars, and DART transit
- San Antonio: Same as Dallas — restaurants, bars, public transit
- Houston: Vaping banned in restaurants, bars, public buildings, METRO transit; some additional restrictions in city parks
- Fort Worth: Aligns with Dallas — public-place restrictions
None of these local ordinances ban purchase or possession by adults 21+ — they regulate where you can vape, not whether you can buy.

What about flavor bans?
Texas has not passed a state-level flavored disposable vape ban. As of 2026, all flavored disposables (mango, blue raspberry, mint, menthol, dessert, tobacco) remain legal for purchase by 21+ adults in Texas. Local cities have not preempted state law on flavor.
